Terms of Service

These Terms of Service ("Terms") govern your use of Call-A-PM ("Service"), a product offered by Idea Sparks, Inc., a Delaware corporation ("Company," "we," "our," or "us").
1. Agreement to Terms
By using Call-A-PM, including calling 1-680-CALL-A-PM, accessing callapm.ai, or receiving SMS messages from Idea Sparks, Inc., you agree to these Terms. When you call our service, you will hear a brief message about these Terms. By continuing the call after this message, you acknowledge and accept these Terms.
If you disagree with any part of these Terms, disconnect the call and do not use Call-A-PM.
2. Service Description
Call-A-PM is an AI-powered product management consultation service provided through:
- Voice-based interactions via telephone, web and mobile app
- SMS, email and mobile app delivery of consultation summaries and artifacts
- Web-based access to generated documents and resources
2.1 Service Limitations
- Our AI product management service provides advisory guidance only
- Recommendations are not guaranteed to be successful or profitable
- The service does not replace human judgment in critical business decisions
- Service availability may vary and is not guaranteed 24/7
- Call quality and AI response accuracy may vary based on network conditions, system load, and other factors
3. User Eligibility and Registration
To use Call-A-PM, you must:
- Be at least 18 years old
- Have the legal capacity to enter into these Terms
- Use the service for legitimate business or educational purposes
- Provide accurate contact information
- Comply with all applicable laws and regulations
4. Communications and Consent
4.1 SMS Communications
By providing your mobile number to Idea Sparks, Inc., you:
- Expressly consent to receive one (1) SMS message per call containing links to your generated documents
- Acknowledge that message and data rates from your carrier may apply
- May opt out at any time by replying STOP to our messages
- Will receive messages only about your specific calls and generated documents
- Understand that SMS delivery is not guaranteed and may be affected by carrier networks
4.2 Call Recording and Monitoring
By using Call-A-PM, you:
- Consent to call recording for quality assurance and service delivery
- Acknowledge that calls are processed by AI systems
- Accept that call content will be used to generate documents and summaries
- Understand that recordings are property of Idea Sparks, Inc.
5. Data Collection and Privacy
Idea Sparks, Inc. collects and processes:
- Voice data from your calls to provide the service
- Your mobile phone number to send SMS messages
- Call metadata (time, duration, frequency)
- Generated content and summaries
- Technical data necessary for service operation
5.1 Data Usage
Your data is used to:
- Deliver requested services and documents
- Improve our AI systems and service quality
- Maintain service performance
- Comply with legal requirements
- Generate aggregate, anonymized service metrics
5.2 Data Protection
Idea Sparks, Inc. protects your data by:
- Encrypting transmissions and storage
- Limiting access to authorized systems
- Maintaining security protocols
- Conducting regular security assessments
- Implementing data retention policies
6. Generated Content
6.1 Content Delivery
- Documents will be delivered via SMS within 5 minutes of call completion
- Access links expire after 30 days from generation
- Idea Sparks, Inc. does not guarantee permanent storage of generated content
- Users are responsible for downloading and storing important documents
- Technical issues may affect document generation or delivery
6.2 Content Accuracy
- Generated content is provided "as is" without warranty
- Idea Sparks, Inc. does not guarantee accuracy or completeness
- Users should independently verify all recommendations and information
- Content may contain general advice not specific to your situation
- AI-generated content may contain errors or inconsistencies
7. Intellectual Property
7.1 Service Ownership
Idea Sparks, Inc. exclusively owns all rights to:
- The Call-A-PM service and AI systems
- All technology and infrastructure
- The Call-A-PM brand and associated assets
- Service methodologies and processes
7.2 User Content Rights
You retain rights to:
- Your specific business information shared during calls
- Your unique implementation of our advice
- Your confidential information discussed in calls
- Your proprietary business processes and methods
- Generated content templates and frameworks
8. Payment and Billing
8.1 Service Fees
- Per-minute rates as displayed at time of call
- SMS delivery included in service cost
- Premium features billed at published rates
- All fees subject to change upon notice
- Delaware sales tax applied where applicable
8.2 Refunds
- No refunds for completed calls
- Partial refunds for verified service interruptions
- Credit adjustments for documented technical issues
- Refund requests must be submitted within 30 days
9. Limitations of Liability
Idea Sparks, Inc. is not liable for:
- Business decisions made based on Call-A-PM advice
- Technical failures beyond our reasonable control
- Accuracy or completeness of AI-generated content
- Consequential damages from service use
- Lost profits or business opportunities
- Service interruptions or data loss
10. Service Modifications
Idea Sparks, Inc. reserves the right to:
- Modify these Terms with 30 days notice
- Change service features or functionality
- Adjust pricing with advance notice
- Discontinue service features
- Limit or restrict service access
11. Termination
Idea Sparks, Inc. may terminate service for:
- Violation of these Terms
- Abusive or harmful behavior
- Fraudulent activity
- Non-payment
- Illegal use of the service
12. Dispute Resolution
- All disputes governed by Delaware law
- Exclusive jurisdiction in Delaware courts
- Mandatory arbitration for all disputes
- Small claims court option preserved
- Class action waiver
- Each party bears own legal costs
13. Severability
If any provision of these Terms is found invalid or unenforceable, remaining provisions remain in full force and effect. Invalid provisions shall be replaced by valid provisions that best fulfill the commercial purpose of the original provision.
14. Changes to Terms
- Material changes effective 30 days after notification
- Continued use constitutes acceptance of changes
- Users responsible for reviewing updates
- Previous versions available upon written request
- Change notifications sent via SMS or email
15. Entire Agreement
These Terms constitute the entire agreement between you and Idea Sparks, Inc. regarding Call-A-PM, superseding all prior agreements or communications. No modification of these Terms is effective unless posted by Idea Sparks, Inc. in a revised version of these Terms.
16. Force Majeure
Idea Sparks, Inc. is not liable for any failure or delay in performing obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemic, natural disasters, power failures, or internet disruptions.
17. Assignment
You may not assign your rights under these Terms without prior written consent from Idea Sparks, Inc. Idea Sparks, Inc. may assign its rights to any subsidiary or successor in interest.
18. Notices
All notices to users will be provided via SMS, email, or website posting. All notices to Idea Sparks, Inc. must be in writing and sent to the mailing address provided in Section 13.
